1. Acceptance of Terms
By accessing or using the BDR Fiduciary Audit website and services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you must not access or use our Services. We reserve the right to refuse service to anyone at any time.

BDR Fiduciary Audit is an independent data information service provider. We provide:

- AI-driven database verification and matching
- Identity resolution for data discrepancy research
- Digital audit report generation
2.2 What We Are NOT
Important Clarification: BDR Fiduciary Audit does NOT:
- Act as a financial or legal agency service provider
- Handle, hold, or transfer client funds
- Provide legal, financial, or tax advice
- Guarantee successful resolution of identified discrepancies
- Serve as a fiduciary or trustee
Note: Our service is limited to providing informational audit reports. Any subsequent verification or resolution actions must be undertaken independently by you or through your chosen legal representative.
3. Eligibility and User Accounts
3.1 Age Requirement
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement.
3.2 Identity Verification
You agree to provide accurate, current, and complete information during the audit process. We may require identity verification to comply with federal and state regulations.
3.3 Account Security
You are responsible for maintaining the confidentiality of your Case ID and any login credentials. You agree to notify us immediately of any unauthorized access to your account.
4. Service Fees and Payment
4.1 Flat Fee Structure
Our forensic audit service is provided for a flat fee of $99.00 USD per audit report. This fee is non-refundable once the audit report has been generated and delivered.
4.2 Payment Processing
Payments are processed securely through third-party payment processors (Paddle/Lemon Squeezy). You agree to provide current, complete, and accurate payment information.
4.3 No Contingency Fees
Unlike traditional data service providers, we do NOT charge percentage-based or contingency fees. Our service fee is limited to the audit report generation and does NOT include any portion of identified assets.
5. Scope of Services and Limitations
5.1 Data Audit Report
Our audit report includes:
- Verified data amount and property ID
- Current holder information (e.g., State Treasury)
- Jurisdiction and location data
- Step-by-step verification instructions (state-specific)
- Required documentation checklist
5.2 Limitations
Our Services DO NOT Include:
- Verify data on your behalf
- Legal representation or advice
- Fund disbursement or handling
- Ongoing case management or follow-up
- Guarantees of successful resolution
5.3 Data Accuracy
While we use AI-driven forensic verification, we cannot guarantee 100% accuracy of all data. State databases may contain errors, outdated information, or incomplete records. You are responsible for verifying information with the appropriate government agencies.
6. User Responsibilities
By using our Services, you agree to:
- Provide truthful and accurate information
- Use the audit report solely for lawful purposes
- Not share your Case ID with unauthorized parties
- Comply with all applicable federal and state laws regarding financial data verification
- Not attempt to reverse-engineer, hack, or compromise our systems
- Not use our Services to commit fraud or misrepresentation
7. Intellectual Property Rights
7.1 Ownership
All content, trademarks, logos, software, and technology used in our Services are the exclusive property of BDR Fiduciary Audit or its licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use your audit report for personal use only. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
7.3 Proprietary AI Technology
Our AI-driven forensic audit algorithms, neural networks, and data processing methods are proprietary trade secrets. Any attempt to reverse-engineer or replicate our technology is strictly prohibited.
8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the fullest extent permitted by law, BDR Fiduciary Audit disclaims all warranties, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Services will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, completeness, or reliability of data
- Warranties that use of our Services will result in successful data resolution
You acknowledge that government databases may contain errors and that final verification approval is at the sole discretion of the applicable state agency or holder.
9. Limitation of Liability
LIMITATION OF DAMAGES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BDR FIDUCIARY AUDIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES.
Our total liability to you for any dispute arising from these Terms or your use of our Services shall not exceed the amount you paid for the audit service (i.e., $99.00 USD).
This limitation applies to all causes of action, including but not limited to breach of contract, breach of warranty, negligence, or any other tort.
10. Indemnification
You agree to indemnify, defend, and hold harmless BDR Fiduciary Audit, its officers, directors, employees, and agents from any disputes, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your misuse of our Services
- Your violation of any third-party rights
- Any fraudulent or illegal activity you engage in
11. Refund Policy
11.1 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee. If you are unsatisfied with the audit report for any reason, you may request a full refund within 14 days of purchase, provided the report ID has not been used for an official filing.
11.2 How to Request a Refund

Refunds will be processed within 5-7 business days to the original payment method.
11.3 Refund Eligibility
Refunds are available if:
- The request is made within 14 days of purchase
- The report ID has not been used for an official state filing or data verification submission
- You provide a valid reason for dissatisfaction
11.4 Refund Exclusions
Refunds are NOT available if:
- More than 14 days have passed since your purchase
- The report ID has been used for an official filing with a state agency or data verification submission
- You cannot provide proof of purchase or order confirmation
- The refund request is made in bad faith or appears fraudulent
Note: This refund policy complies with FastSpring's Merchant of Record standards and applicable consumer protection laws. All refunds are processed through FastSpring's secure payment infrastructure.
12. Termination
We reserve the right to suspend or terminate your access to our Services at any time, with or without cause or notice, including if we believe you have violated these Terms.
Upon termination, your right to access the Services will immediately cease. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will remain in effect.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before filing a formal dispute, you agree to contact us at alex.chen@bdr-fiduciary-audit.com to attempt to resolve the issue informally.
13.2 Binding Arbitration
If informal resolution fails, any dispute arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
Arbitration will take place in Santa Clara County, California. You and BDR Fiduciary Audit agree to waive the right to a jury trial.
13.3 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY, NOT AS PART OF A CLASS ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Santa Clara County, California.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date at the top of this document
- Sending email notification (for significant changes)
Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
